Introduction

Notice: Please read this document carefully before using this website. Do not use this website if you do not agree with the terms and conditions present in this document. Use of this website signifies compliance with these Terms of Use.

 

The market site www.northhill.fr (hereinafter named the “Site”) is a site of electronic commerce accessible through the internet, open to all users of this medium (hereinafter named “Internet users”). It is edited by the company North Hill S.A.R.L(hereinafter named “ North Hill ”), SARL with a capital of 5000 Euros, the headquarters are located at 65 rue Notre Dame de Nazareth, 75003 Paris, signed with the “Registre du commerce et des Sociétés de Paris” under the number 804 092 328.

The site allows North Hill to offer textile products and accessories for sale with North Hill brand or any of their business partners (hereinafter named “products”) to internet users that navigate on the site (hereinafter named “clients”). For the application of the presenters, it is decided that the Client and North Hill will be collectively named "Parties" and individually named "Party", and that the client that has validated an order will be named "Buyer".

All orders of a Product offered on the Site imply the Buyer to adhere to the following terms and conditions of sale. North Hill reserves the right to modify at any moment the present terms and conditions of sale by publishing a new version on the Site. The general terms and conditions of sale are those that are put in place on the date the purchase is made.

Article 1. Object

The current terms and conditions of sale govern the rights and obligations of the Parties resulting in the online sale of Products offered on the Site, these apply with the exclusion of any other document.

Article 2. Products – Price

2.1 Products

Only the products featured on the Site on the day it is consulted by the Client are offered for sale. The offer of product and price are available, within limits of available stock, as long as they are offered on the Site. The photographs reproduced and illustrating the presented products are not contractual.

2.2 Price

The prices are indicated in Euros all taxes included. The prices that are applied are the ones figuring on the Site at the time the order is being made. The sum of the all-inclusive price of the fees for preparation and delivery will be communicated to the client on the receipt summary, before the validation of the aforementioned document. Please be reminded that shipments destined outside of the European Community are subject to import taxes and duty fees (DDU Deliver Duties Unpaid) based on your home country's regulations.

Article 3. Order

3.1 Registering the Order

The Client that wishes to make an order chooses the item or items of his or her choice by clicking on "Add to Cart". At any time the Client can:

- Verify the number of Products in his basket and obtain detailed information on each item by clicking on "My Cart", or the "My Cart" icon,

- A new Client must fill out all required fields of information in order to create his or her client account. The Client must fill out the form given to him or her with exactitude, which will include the information needed to determine his identification, including his electronic address and a password of his or her choosing (which will be personal to him as well as confidential) which will in turn allow him or her to identify himself on the site.

Every client that already has a password must identify himself after clicking on "Confirm", by entering his or her email address and his or her password. The Client accepts that this method of identification can prove his or her identity. It is an obligation to provide the nominative information to be a vendor from a distance, this information is necessary for the treatment and delivery of orders, and for the purpose of billing. This information is strictly confidential. After having made an order, and once all of the information required has been completed by the Client, he or she will be aware of the general terms and conditions of sale to which he will agree to by checking off the square.

3.2 Validation of the order

The validation of the confirmation of the cart constitutes an electronic signature. To the Parties this signature is the equivalent to a signed manuscript and is proof of the integrity of the order and the payability of the sum due of the said order.

Once he or she has validated the order, the Client becomes a buyer.

Notwithstanding the application of article R624-3 of the penal code, the Client will pay his or her order with a banking card (carte bleu, Visa, Eurocard/Mastercard). If the Client wishes to make payment with a bank card, he or she must provide the bank card number. The type of card, the expiration date, as well as the cryptogram will need to be provided.

3.3 Payment

The price owed by the Buyer is the amount indicated on the summary note of the order. In any case, the amount debited will correspond to the Product(s) to be delivered. It is specified that when choosing a bank card as a method of payment the buyer is transferred automatically towards the electronic banking server at Ingenico. The payment of your purchases is carried out exclusively, when placing your order, by bank card (Carte Bleue, Visa, Maestro, Eurocard/Mastercard, American Express) or via a PayPal account. The debit of your bank card or your PayPal account is made no later than six (6) days after placing your order, in the currency thereof.

Purchases are made securely. NORTH HILL uses 100% secure payment solutions. For payments by credit card (debit or credit card, Visa, mastercard and Amex), Payplug or Paypal are responsible for ensuring the security of payments. All information provided by customers to NORTH HILL is rigorously protected ensuring the confidentiality and security of each transaction.

Payment card numbers are not stored on our website but on the secure website of the Stripe banking institution.

As part of the process of payments made by electronic means, and to combat the fraudulent use of online payment methods, we carry out verification of the reliability of the information entered by you when registering your order.

 

3.4 Acknowledgement of Receipt of order

Once payment has been made, a summary document of the order is sent to the Buyer to his or her electronic address. This document serves as an acknowledgment of receipt and is a summary of all the items included in the contract between parties.

Article 4. Delivery

NORTH HILL delivers its Products worldwide. Products are dispatched with the relevant delivery note, and sent to the delivery address provided by the Customer at the time of ordering. Delivery cannot be made to hotels or PO boxes. Delivery times quoted on the site are approximate times, which represent average processing and delivery times, only on business days. In order for these delivery times to be met, the customer must ensure that he/she has provided accurate and complete information with regard to the delivery address (for example, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).

In the event of a delivery delay of more than 10 working days, if the product has not been dispatched, the Customer may cancel the order by registered letter with acknowledgement of receipt or by email and request that the order be refunded.

If the item is dispatched prior to receipt of the cancellation of the order due to a delivery delay of more than 10 days, NORTH HILL will refund the item and the delivery and return costs, on receipt of the complete item, in its original condition and with all labels still affixed.

NORTH HILL undertakes to inform the Customer of the progress of the processing of his/her order.

Article 5. Receiving the order

Upon reception of the order, the Buyer will verify the conformity of the Products received following the execution of the order. Any anomalies concerning the delivery (for example: missing or damaged Product, damaged packaging) must be notified imperatively, in the fourteen (14) days following the reception of the Products. IMPORTANT NOTICE: The order may be delivered in several instances. Unless there is a legitimate motive, any claim that is made after the 15 days following the reception of the Products will be considered inadmissible, North Hill will not be liable. North Hill reserves the right to ask the Buyer to return the Product if it is non-compliant or damaged. In the case of an abnormal or improper return, North Hill can refuse any other orders.

Article 6. Right to retract

The Buyer is entitled to a delay of fourteen (14) business days counting from the date of reception to return, at his or her own charge, the Product(s) that he or she has ordered. The Product(s) will have to be returned in its original packaging. If the conditions mentioned above are fulfilled, North Hill will reimburse the Buyer for the total amount of his order, within thirty (30) days of the reception of the Products North Hill, excluding the charges incurred when sending the Products back which is the Buyers charge to bear.

Article 7. Guarantee

NORTH HILL has only an obligation of means with regard to all stages of access to the site, from the order process to the dispatch of the parcel or subsequent services. NORTH HILL cannot be held liable for any inconvenience or damage arising from the use of the Internet, in particular in the event of a disruption of service, external intrusion, or the presence of computer viruses or any other incident of force majeure, in accordance with legislation and case law.

All our products benefit from a legal guarantee, abiding that the use of said product was normal and that instructions be adhered to.

Article L211-4 of the consumer code

The vendor is obliged to deliver goods that are in adherence to the contract and to answer defects that do not adhere to conformity existing when said product is delivered.

 

Article L211-5 of the consumer code

To conform to the contract, the goods must:

1° must be suited for the habitual type of usage expected from a similar good:

- Correspond to the description given by the vendor and possess the quality that the aforementioned presented to the Buyer in sample or model form;

- Present the qualities that a Buyer could legitimately expect and in relevance to the public declarations made by the vendor, by the producer or by their representative, notably in advertisements or labeling;

2° Or present characteristics defined by a common agreement by the parties or be applied to all special usage sought by the Buyer, which the vendor was aware of and accepted.

Article L211-12 of the consumer code

The operation resulting in a default to the conformity has a statute of limitations from two years starting from the delivery of the goods.

Article 1641 of the civil code

The vendor is obliged to guarantee in the case of hidden defaults of the product sold which render it improper to the use is destined to, or that it restricts so much that usage, that the Buyer would not have purchased it, or would have bought it for a fraction of the price, if he had known they existed.

Article 1648 Indentation 1 of the civil code

The event that is the result of insurmountable vices must pursue legal action within a two-year delay of the discovery of said vice.

Article 8. Computing and rights

Personal data may be gathered on the site and used by North Hill which acts as data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (hereinafter "General Data Protection Regulation" or "GPDR").

North Hill is obliged to ensure the security and confidentiality of its customers' personal data in accordance with the GDPR. Customers' personal data (surname, first name, postal address, telephone number, email address) may be disclosed to North Hill service providers and partners, should their involvement be necessary in the processing and management of orders. These service providers and partners can only act on instructions from North Hill.

  • The purposes of the collection of personal data are detailed below:
  • Processing of Customer orders (delivery, return, refund)
  • Data relating to an order that has been placed will be transmitted to our banking service provider while payment is being made for validation of the payment.
  • If the Customer has ticked the box to subscribe to the North HIll Newsletter, he/she expresses his/her consent to receiving the brand's marketing communications.
  • In accordance with the GDPR, the Customer has a right of access, rectification and opposition to the personal data concerning him/her (hereinafter referred to as the " Data Protection Rights").
  • In accordance with data protection legislation, the Customer has the right to:
  • Request a copy of all information held about him/her.
  • Request the correction of his/her personal data.
  • Request the total deletion of his/her account and personal data.
  • To exercise this right the Customer must submit a request by email to: contact@northhill.fr, using the contact form or by post to: North Hill, 65 rue Notre Dame de Nazareth, 75003 Paris FRANCE stating his/her surname, first name, e-mail address and customer reference. The customer's request must be signed and accompanied by a photocopy of an identity document.
  • In accordance with the "Data Protection Rights" law, a response will be provided as soon as possible and at the latest within one month of the request.
  • Storage of your data
  • Data is kept for no longer than necessary for the purposes for which it was collected.

  • contact@northhill.fr will provide you with further information about your rights and obligations in relation to your personal data. He will also be the contact person for managing any request you may have about your personal data.

North Hill may send its Customers marketing information related to the brand by post, e-mail, text message and/or telephone, subject to prior consent.

The Customer may at any time object to these marketing communications by clicking on the "unsubscribe" link at the end of the marketing emails, by sending a request by email to contact@northhill.fr, by post, or by replying STOP by text message (within 3 days of receipt of a North Hill text message campaign). 

Article 9. Various stipulations

9.1 Force Majeur

In the event of an event of force majeure, the party concerned must inform the other party within fourteen (14) days of the occurrence of such an event, by registered letter with acknowledgement of receipt.

The following are expressly considered to be cases of force majeure or unforeseeable circumstances, in addition to those usually recognized by the French courts and tribunals, total or partial strikes, lockouts, riots, boycotts or other actions of an industrial or commercial nature, civil unrest, insurrection, war, bad weather, epidemic, obstruction of means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal or regulatory changes to forms of trade, computer failure, obstruction of telecommunications, including wired or wireless telecommunications networks, and any other event beyond the control of the parties preventing the normal performance of the contractual relationship.

All obligations of the parties will be suspended for the duration of the event of force majeure, without compensation.

Should the event of force majeure last for more than three (3) months, the contract may be terminated as of right without compensation for either party.

9.2. The contract in its entirety

The present terms and conditions of sale and the summary of the order sent to the Buyer, constitute a contractual and integral summary of the conventions that occur between the parties.

9.3 Conservation and archiving transactions

The archiving of bills is done in a viable and durable backing method so as to correspond to a trustworthy and durable copy.

9.4 Applicable Law – competent jurisdiction.

The present terms and conditions of sale and the contractual relation between North Hill and the Buyer are subject to French law. In case of litigation, the Paris tribunal of commerce will be called upon. However, North Hill are always open to finding an amicable solution before any legal action is taken.
